CONCERNING
REVOCATION OF REGULATION OF THE MINISTER OF TRADE No. 16/M-DAG/PER/5/2009 CONCERNING TEMPORARY BAN ON THE IMPORT OF SWINE AND BY PRODUCTS

BY GRACE OF THE ALMIGHTY GOD,
THE MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA,

Considering:

a. that pursuant to Article 4 b of Regulation of the Minister of Trade No. 16/M-DAG/PER/5/2009 concerning Temporary Ban on the Import of Swine and By Products, the regulation may be revoked in case result of coordination with related technical institutions stating that the temporary ban on the import of Swine and by Products expires partly or wholly;
b. that the limited coordinative meeting in the field of the People's Welfare on June 29, 2009 has decided to revoke the regulation of the Minister of Trade concerning Temporary Ban on the Import of Swine and by Products, because no disease infecting human from Swine is found;
c. that result of risk analysis and recommendation of World Organization for Animal Health (WOAH/OIE) on June 11,2009 about Novel Influenza A/H1Nl Pandemic: the OIE maintains its recommendations to animal health authorities worldwide state that the hygienically treated swine as recommended by Food and Agriculture Organization (FAO), Office International des Epizooties (OIE), World Health Organization (WHO), and Codex Alimentarius Commission (CAC), does not become a source of infection from Influenza (A/H1Nl) virus;
d. that based on consideration in a, b and c, it is necessary to stipulate a regulation of the Minister of Trade;

In view of:

14. Presidential Regulation No. 10/2005 concerning First-Echelon Organization Units and Tasks of State Ministries as amended several times and the latest by Presidential Regulation No. 50/2008;
15. Presidential Regulation No. 47/2009 concerning the Establishment and Organization of State Ministries;
16. Presidential Decree No. 84/P/2009 concerning the Establishment of United Indonesia Cabinet II;
17. Regulation of the Minister of Trade No. 01/M-DAG/PER/3/2005 concerning the Organization and Work Mechanism of the Ministry of Trade as amended several times and the latest by Regulation of the Minister of Trade No. 24/M-DAG/PER/6/2009;
18. Regulation of the Minister of Finance No. 161/PMK.04/2007 concerning Supervision over the Import or Export of Banned and/or Restricted goods;
19. Regulation of the Minister of Agriculture No. 20/PERMENTAN/OT.140/4/2009 concerning Importation and Distribution Control of Carcass, Meat and/or Offal from Abroad;
20. Regulation of the Minister of Trade No. 54/M-DAG/PER/10/2009 concerning General Provisions in Import;
21. Regulation of the Minister of Agriculture No. 21/Permentan/OT.140/2/2010 concerning the Import of Swine and By Products into the Territory of the Unitary State of the Republic of Indonesia;

DECIDES:

To stipulate:

THE REGULATION OF THE MINISTER OF TRADE CONCERNING REVOCATION OF REGULATION OF THE MINISTER OF TRADE No. 16/M-DAG/PER/5/2009 CONCERNING TEMPORARY BAN ON THE IMPORT OF SWINE AND BY PRODUCTS

Article 1

Regulation of the Minister of Trade No. 16/M-DAG/PER/5/2009 concerning Temporary Ban on the Import of Swine and By Products shall be revoked and declared null and void.

Article 2

The regulation shall come into force as from the date of stipulation.

For public cognizance, the regulation shall be promulgated by placing in the State Gazette of the Republic of Indonesia.
